Georgia lawmakers introduce e-cigarette registration bill

A Georgia lawmaker is seeking the state to establish a registry of U.S. Food and Drug Administration-approved vaping products.

The goal is to let retailers and consumers know what is and is not legal. The bill has been introduced in committee.

Legislator Houston Gaines showed several examples of illegal vaping products. Media reports also noted that if you check the back, you’ll find “Made in China.” Nearly all vaping hardware products, legal or otherwise, are manufactured in China.

The FDA won't approve them, so Gaines said Georgia shouldn't approve either. The FDA does not approve e-cigarette products for sale; it only authorizes them.

The state Department of Agriculture will maintain and publish this list. Any product not on this list cannot be legally sold in Georgia.

There were so many attendees at Monday afternoon's committee hearing that the committee chair agreed to hold a second hearing so everyone could have their say, but some vehemently objected.

Vape shop owner Dillon Gilbert was among those speaking out Monday, insisting the bill would destroy their industry.

“I own vape shops in Savannah and Columbus,” Gilbert said. "We need common sense regulation, but unfortunately this bill is a fatal blow to our industry."

But Gaines insists the bill will help get vaping products containing fentanyl or THC off the shelves. No nicotine e-cigarette products have been found to contain fentanyl. The GFDA does not regulate THC products.

Under the bill, any store found to be selling these unapproved vaping products could face severe fines and could have their license revoked.

Louisiana passed a law prohibiting retailers from selling e-cigarette products that are not listed on the state’s approved registry, known as the VAPE Directory. Alabama and Florida use the same list. Nebraska is also seeking to pass a bill to establish an e-cigarette registry in the state.
