CPC certification: Is fingertip gyroscope a universal product or a children's product?

What is a fingertip gyroscope?

Fingertip gyroscopes typically consist of two main parts, a central part containing small ball bearing components and an external part. External components typically have multiple raised corners, which contain small ball bearing components, solid weights, or balls. Fingertip gyroscopes can be made of various materials, including plastic, brass, stainless steel, titanium, and copper. The user holds the middle part with their index finger and thumb, and then rotates the outer part to "rotate" it. The blades of the fingertip gyroscope have the same weight to allow users to balance the product.



Is the fingertip gyroscope a universal product or a children's product?

Universal products: Most fingertip gyroscopes are universal products unless they are primarily intended for use by children aged 12 and below.

Children's products: Some fingertip gyroscopes may be children's products. CPSC considers the following factors when determining whether a product is a children's product: marketing materials, whether the product and packaging design are primarily aimed at attracting children aged 12 and under, and the age classification of the product.



What requirements must the product meet?

If your fingertip gyroscope is a universal product, there are no mandatory CPSC requirements for it. However, manufacturers and retailers of fingertip gyroscopes containing rechargeable battery powered components should ensure that rechargeable lithium-ion batteries are used within their correct operating specifications for voltage, current, and temperature. Rechargeable fingertip gyroscopes without an appropriate battery management system (BMS) may lead to overheating and fire risks. CPSC recommends all battery powered fingertip gyroscopes, including general purpose products and children's products; Comply with the battery requirements in section 4.25 of the American Toy Standard ASTM F963-17 for battery powered toys.

Children's products must be tested by a CPSC accredited laboratory to ensure that they comply with all applicable safety requirements mentioned above.



What certification is required for the manufacturer and importer of this product?

If your fingertip gyroscope is a universal product and not primarily intended for use by children aged 12 and below, certification is not required.

If the fingertip gyroscope is mainly used by children aged 12 and below, it is a children's product, and the manufacturer and importer must prove in the children's product certificate (CPC) that the product meets the above requirements. After creating the certificate, you need to provide it to any distributors or retailers that may collaborate with you. You do not submit it to CPSC; However, the certificate must be attached to any goods and must be presented to the Customs and Border Protection (CBP) or CPSC upon request.


What other obligations do manufacturers, distributors, and retailers of fingertip gyroscopes have?

According to Article 15 of the Consumer Product Safety Law, manufacturers, distributors, and retailers of consumer goods have a legal obligation to report to the committee upon receiving information that reasonably supports the following conclusions of the product:

1. Failure to comply with applicable consumer product safety regulations;

2. Failure to comply with any other rules, regulations, standards, or prohibitions required by the Consumer Product Safety Act or any other act implemented by the Commission;

3. Including defects that may cause significant product harm; perhaps

4. Unreasonable risk of causing serious injury or death.
