California bans bisphenols in two baby products

On September 27, 2024, the Governor of California signed SB 1266 (Senate Bill No. 1266), amending Sections 108940 and 108941 of the Health and Safety Act involving environmental health and children's product safety, and adding Section 108942. Effective January 1, 2026, the bill prohibits bisphenols in underage feeding products and underage sucking or teething products.

In October 2011, California enacted the Toxic-Free Infants and Toddlers Act, which limits the amount of bisphenol A (BPA) in food-contact bottles or cups used by children three years old or younger to no more than 0.1 ppb.

California has now approved SB1266, a bill that further bans bisphenols in products for underage feeding and products for underage sucking or teething.

Effective January 1, 2026, no person may manufacture, sell or distribute any underage feeding products and underage sucking or teething products that contain any form of bisphenols in excess of the Practical Quantitation Limit (PQL), as specified in the PQL Values will be determined by the Division of Toxic Substances Control, DTSC.

However, this restriction does not apply to medical devices, or food and beverage containers primarily designed or used to contain liquids, foods, or beverages for consumption by the general population.



▋Act Definition

1. “Minor feeding product” means any consumer product sold in California for use by minors, marketed to, sold to, offered for sale, or distributed to minors that is designed or intended by the manufacturer to be packaged primarily for minors to feed from that product. Any liquid, food or drink consumed or consumed from a bottle or cup.

2. “Minor sucking or teething product” refers to any consumer product sold in California for use by minors, marketed, sold, offered for sale, or distributed to minors that is designed or intended by the manufacturer to assist minors in sucking or teething. Teething to promote sleep or relaxation.

3. "Minor" refers to an individual under the age of 12.

4. "Bisphenols" refers to chemical substances that connect two phenol rings with a connecting atom. There may be other substituents connecting the atoms to the phenol ring.
