Annex III of the EU RoHS Directive adds a new exemption clause for lead and cadm

On January 10, 2024, the Official Journal of the European Union published Directive (EU) 2024/232, adding a new Article 46 exemption to Annex III of the RoHS Directive. The directive will take effect 20 days after issuance, that is, it will officially take effect on January 31, 2024. Member States shall adopt and publish the laws, regulations and administrative provisions required to comply with this Directive no later than July 31, 2024. These provisions shall apply from August 1, 2024.





Add exemption clause

Annex III of the RoHS Directive currently contains a series of exemptions to allow the use of certain hazardous substances in specific circumstances.

On 14 December 2015, the European Commission received an application under Article 5(3) of Directive 2011/65/EU for the control of cadmium and lead in electrical and electronic doors and windows containing recycled polyvinyl chloride (PVC). Grant exemption ("request exemption"). Cadmium and lead are used in recycled PVC door and window frame materials and for polymer stabilization of PVC profiles.

Although lead- and cadmium-free PVC is commercially available, the energy and natural resources required to use recycled PVC (such as water, oil, and natural salts) are higher than those required to use PVC. Want less. Therefore, the overall negative impacts of substitution on the environment, health, and consumer safety are likely to outweigh its overall benefits on the environment, health, and consumer safety. The requested exemption therefore complies with at least one of the relevant conditions set out in point (a) of Article 5(1) of Directive 2011/65/EU. This exemption will not weaken the environmental and health protection provided by the REACH regulations, so this exemption is approved. The exemption will expire on May 28, 2028.
