On April 23, 2015, the European Union issued a new Regulation (EU) 2015/628 to amend the lead related restrictions in Annex 17 of REACH Regulation, which will come into force on May 12, 2015.
The new regulations have revised "Article 63 - Lead and its mixture" in Annex 17 of REACH, and added new restrictions, that is, for articles or accessible parts that can be put into the mouth of children under normal use and foreseeable circumstances, if the lead content is ≥ 0.05%, they shall not be put on the market or used, and the lead release is ≤ 0.05 μ G/cm2/h products need not meet this requirement; Products put on the market for the first time before June 1, 2016 need not meet this requirement.
Restrictions
Lead and its mixture
If the Pb content in articles or accessible parts for public use is ≥ 0.05% (mass ratio), they shall not be put on the market or used. These articles or accessible parts may be put into the mouth of children under normal use or foreseeable circumstances.
This limit does not apply to lead releases not exceeding 0.05 μ G/cm2/h (equivalent to 0.05 μ G/g/h), whether coated or uncoated; And for coated articles, the coating can fully ensure that the lead release rate will not exceed this requirement during at least two years of normal or predictable use.
The purpose of this paragraph is to consider that an object or accessible part may be put into the mouth of a child if any of its dimensions is less than 5cm, or contains separable or protruding parts with dimensions less than 5cm.
On June 8, 2022, the World Trade Organization (WTO) issued Circular G/TBT/N/EU/897 on the proposal of the European Commission to amend the restrictions on lead in Item 63 of Annex XVII of (EC) No 1907/2006 and to add restrictions on the use of lead and its compounds in PVC articles. The draft notification will be subject to 60 days of public consultation. The proposed adoption date is the last quarter of 2022, and it is intended to take effect on the 20th day after the publication of the Official Journal of the European Union.
If the concentration of lead in PVC material (expressed in lead metal) is equal to or greater than 0.1% (by weight), the PVC article shall not be put on the market.
