The certification of children's products must be based on qualified test results from third-party testing. Third party testing laboratories provide testing services and results, but do not issue children's product certificates.
Who must issue a Children's Product Certificate (CPC)?
Manufacturers or importers are responsible for drafting and publishing product general classifications. Manufacturers or importers can draft CPC free of charge based on the qualified results of third-party testing.
Importers must issue CPC for products manufactured overseas, while US manufacturers must issue CPC for products manufactured domestically. See 16 CFR Part
1110. Please note that in the case of an importer issuing a certificate, the importer does not need to be physically located within the United States; They also do not need to list addresses in the United States to comply with parts 3 and 4 of the certificate.
Manufacturers or importers of children's products that are subject to safety regulations or other standards for children's products always have legal responsibility for publishing the CPC, even if a third-party testing laboratory or another third party helps draft the CPC.
