Introduction to Regulation 1907/2006 on REACH SVHC Certification in the European Union
1、 REACH stands for European Community Regulation 1907/2006 (REACH Regulation), which came into effect on July 1, 2007 and directly applies to all EU member states. It also applies to European Economic Area countries as it is also included in European Economic Area agreements.
2、 The REACH regulation aims to improve the protection of human health and the environment from potential risks of chemicals. On the one hand, this should be achieved through appropriate risk management measures. On the other hand, substances of high concern will gradually be replaced by other suitable but less hazardous substances. To achieve this goal, the core provisions of the REACH regulation cover the following key aspects:
1. The obligation to register substances, including detailed information on their properties, in order to establish a substance database;
2. The obligation to share information on material characteristics and risk management measures in the supply chain;
3. Evaluation of these substances by member states;
4. Determine the limitations or * of certain substances;
3、 According to the principle of "no data, no market", substances regulated by REACH regulations can only be placed on the market in the European Union or the European Economic Area after prior registration with the European Chemical Administration (ECHA). The obligation to register lies with manufacturers of substances within the European Union and/or importers of substances imported from non EU/EEA countries. When registering substances, it is necessary to indicate their composition and properties, and submit a chemical safety report, which includes a description of the exposure path * of the substance, its impact on human health and the environment, and a risk assessment when handling these substances based on this, And suggestions for risk management measures (if applicable).
1. When determining whether a substance belongs to a hazardous substance, REACH explicitly mentions the standards of the "CLP Regulation" (Regulation (EC) 1272/2008 on the classification, labeling, and packaging of substances and mixtures). If a substance is a hazardous substance, its property and any necessary risk management measures must be compiled in a safety data sheet, which must be forwarded throughout the entire supply chain.
2. All EU member states nominate their national authorities responsible for coordinating with the European Chemicals Administration (ECHA) to evaluate these substances. The prioritization of substances in this evaluation process is based on a risk driven approach - that is, to first evaluate substances that are associated with high risk, and the risk of substances depends on their characteristics (such as persistence, bioaccumulation), exposure pathways, or overall production or import volume.
3. Based on the evaluation results and in accordance with the REACH regulations, substances may be subject to restrictions or procedures, which may include manufacturing, placing on the market, or using a certain substance, mixture, or item separately. The procedures aim to ensure that the risks associated with substances of high concern are properly managed and gradually replaced with other suitable alternatives.
